Big Body Tees — Messaging Policy (Email & SMS)

This policy explains what email and text messages we send, when, and how to stop them. It is consistent with the Customer Agreement §13 and the Privacy Policy. Where they conflict, this policy controls messaging mechanics.

Plain-language summary

  • We send transactional messages (proof links, status updates, payment receipts, pickup notifications) to fulfill your order. You cannot opt out of these without canceling the order.
  • We send marketing messages (reorder reminders, promotions, new product news) only if you've opted in. You can opt out any time by replying STOP to a text or clicking unsubscribe in any marketing email.
  • We will never sell your phone number or email address. Period.

1. Two categories of messages

We separate every message we send into one of two buckets. The legal rules and your options differ between them.

1.1 Transactional messages

These are messages we send because you placed an order and we need to communicate about it. Federal law (CAN-SPAM, TCPA) treats them as required for the service you bought.

Examples:

  • Order confirmation when your deposit clears
  • Digital proof for your approval
  • "Production complete" / "Ready for pickup" / "Shipped + tracking" notifications
  • Payment receipts and final invoices
  • Replies to your direct questions
  • Account or order changes you initiated

Frequency: triggered by order milestones. You'll get roughly 4–8 messages per order.

You cannot opt out of transactional messages without canceling the order. If you reply STOP to a transactional message, we will pause future messages on that channel and call you instead — but this may delay your order.

1.2 Marketing messages

These are messages we send to encourage repeat business. Federal law (TCPA for SMS, CAN-SPAM for email) requires your express opt-in for marketing.

Examples:

  • Reorder reminders (we send one around 30 days post-delivery)
  • Anniversary outreach (around 365 days post-delivery)
  • New product announcements (hoodies, polos, etc.)
  • Seasonal promotions
  • Cold reactivation campaigns

Frequency: low. Expect 0–1 emails per month and, if you opt in, 0–2 texts per month.

You can opt out at any time. We'll honor it within 24 hours and keep your contact on a suppression list to prevent re-enrollment.

2. How you opt in

You opt in to email marketing by ticking a box on the lead form, on a quote acceptance page, or on a future signup form. Pre-checked boxes are not used; opt-in is always affirmative.

You opt in to SMS marketing by either (a) ticking an SMS-marketing checkbox at checkout (Phase A), or (b) replying YES to a one-time invitation text we send after your first delivered order. The invitation text will include the message and data rates disclosure required by the carriers.

Transactional messages do not require opt-in — they are part of the order service you bought.

3. How you opt out

Email

  • Click "Unsubscribe" at the bottom of any marketing email
  • Email hello@bigbodytees.com with the subject "Unsubscribe"

We honor unsubscribes within 10 business days, as required by CAN-SPAM. In practice, the click-to-unsubscribe is processed instantly.

SMS

  • Reply STOP to any marketing text
  • Reply STOP, END, QUIT, CANCEL, UNSUBSCRIBE, or similar — all are recognized
  • Email hello@bigbodytees.com with the subject "STOP TEXTS — [your phone number]"

We honor SMS opt-outs within 24 hours, as required by the carriers and by TCPA implementing regulations. Once you opt out, you remain on our suppression list until you affirmatively opt back in.

To opt back in: reply START to any number we previously messaged you from, or email us.

4. SMS-specific disclosures (required for compliance)

  • Message frequency: 0–2 marketing messages per month (frequency may vary based on campaigns).
  • Message and data rates may apply. Standard text-message charges from your carrier may apply.
  • Reply HELP for help, or contact hello@bigbodytees.com or [PHONE].
  • Reply STOP to opt out.
  • Carriers are not liable for delayed or undelivered messages.
  • We are registered for A2P 10DLC messaging through Twilio under our LLC's brand. We use a single dedicated business number; we do not spoof, rotate, or borrow numbers.

5. What we do not do

  • We do not buy or rent phone or email lists.
  • We do not sell, rent, lease, or otherwise share your contact information with third parties for their marketing.
  • We do not send messages on behalf of other businesses.
  • We do not contact you outside reasonable hours for your local time zone without a direct order-related reason.
  • We do not use auto-dialers or pre-recorded voice messages.
  • We do not send marketing messages to numbers on the National Do Not Call Registry without an established business relationship and your express opt-in.

6. Suppression and re-engagement

When you opt out, we add your contact to a permanent suppression list. We do not delete the suppression record because (a) doing so would let us accidentally re-add you to marketing, and (b) we want a clear audit trail showing we honored your request.

If you opt out and then want to opt back in later, you must affirmatively opt back in via one of the methods in §3. We will not assume that placing a new order with us re-grants marketing consent.

7. Children

We do not knowingly collect contact information from anyone under 18. If we learn we have, we will delete it.
